License Reinstatement Services

Get Back on the Road Legally

Without your CDL, you can’t earn a living. When your driver’s license is denied, suspended, cancelled, or revoked, you need qualified legal assistance to navigate the reinstatement process.

Our Commercial Drivers Legal Plan provides 2.5 hours of attorney time to help resolve license issues that threaten your ability to work, whether they stem from job-related complications or medical requirements.

When License Reinstatement Services Apply

The license reinstatement benefit provides legal assistance in three specific situations where your driving privileges are at risk:

License Denial – When you’re denied a driver’s license during the application or renewal process, our attorneys can help you understand the reasons for denial and work to resolve the underlying issues that prevent approval.

License Cancellation, Suspension, or Revocation – If your driver’s license has been cancelled, suspended, or revoked by the Department of Public Safety or Department of Motor Vehicles, you receive legal assistance where a right to appeal is provided by statute. This includes understanding your appeal rights and navigating the administrative process.

Job-Related or Medical License Issues – When you need assistance to reinstate or maintain your driver’s license because of job-related complications or medical requirements, our attorneys provide guidance on meeting regulatory standards and resolving compliance issues.

How the Service Works

You and your spouse each receive up to 2.5 hours of legal assistance from a Commercial Drivers Legal Plan attorney for each qualifying situation. This time allocation allows for thorough case review, document preparation, and representation in administrative proceedings or appeals where applicable.

The attorneys assigned to your case understand the complexities of commercial driver licensing and the Department of Transportation medical requirements that can affect CDL eligibility. They work within the administrative systems to help resolve issues that could otherwise sideline your career for extended periods.

This benefit recognizes that license issues often involve bureaucratic processes that can be overwhelming for drivers trying to resolve problems while maintaining their livelihoods. Professional legal guidance helps navigate these systems more effectively than attempting to handle complex administrative procedures alone.

The Stakes of License Problems

For commercial drivers, license issues create immediate income disruption and long-term career consequences. Every day your CDL remains invalid represents lost earnings and potential job opportunities. Additionally, unresolved license problems can:

  • Prevent you from operating any commercial vehicle
  • Disqualify you from employment with safety-conscious carriers
  • Create gaps in your driving record that raise questions with future employers
  • Compound into more serious regulatory violations if not properly addressed
  • Impact your ability to maintain required insurance coverage

Professional legal assistance helps resolve these issues more quickly and thoroughly than attempting to navigate complex administrative systems without guidance.

Coverage Limitations and Scope

The license reinstatement benefit provides 2.5 hours of attorney time per qualifying incident. While this covers initial case review, document preparation, and basic representation, more complex cases requiring extensive litigation or multiple hearings may require additional legal services at your expense.

The service applies specifically to situations where you have a statutory right to appeal or where assistance is needed for job-related or medical license requirements. It does not cover license issues that result from criminal convictions or violations that fall outside these specific categories.

You remain responsible for all administrative fees, court costs, and any expenses required by licensing authorities during the reinstatement process. The benefit covers legal representation and guidance but not the governmental costs associated with license restoration.

Working Within Administrative Systems

License reinstatement often involves working within Department of Motor Vehicles or Department of Public Safety administrative systems that have specific procedures, deadlines, and documentation requirements. Attorneys familiar with these processes can help ensure proper paperwork submission, deadline compliance, and effective communication with licensing authorities.

The legal assistance also extends to understanding medical certification requirements for commercial drivers, including DOT physical requirements and medical variance procedures that may be necessary to maintain CDL eligibility.

This professional guidance can mean the difference between quick resolution and prolonged license suspension that extends your time away from earning income.

Frequently Asked Questions

Legal protection for commercial drivers involves many important details. Here are answers to the most common questions about our membership plans and how they work to protect your driving career and livelihood.

Have Any Questions?

Don't see the answer you're looking for? Our team is ready to help you understand how our legal membership plans can protect your CDL and career.

RightsVantage partners with LegalShield, one of our preferred membership providers, to offer Commercial Driver Legal Plans specifically designed for transportation professionals. These plans provide access to legal representation for moving violations, DOT compliance issues, CDL protection, and tragic accident coverage. LegalShield has over 50 years of experience serving more than 4.5 million people across North America through their network of qualified Provider Law Firms.

Time is critical with your membership benefits. You must contact your Provider Law Firm within three business days of receiving any citation to ensure coverage under your moving violation benefits. You can call 1-800-634-2391 or use the LegalShield mobile app to photograph and submit your ticket directly. Waiting longer than three business days may disqualify you from coverage for that specific violation.

Your membership covers attorney representation and legal services, but you remain responsible for fines, court costs, penalties, expert witness fees, and any bonds or bail. Think of your membership as covering the lawyer's time and expertise, while financial consequences of violations remain your responsibility. Additional legal services not covered by your plan are available at a 25% discount from standard rates.

Your Commercial Driver Legal Plan has a 10-day waiting period, meaning benefits become active on the 11th day after enrollment. Any legal matters occurring before this waiting period ends are considered pre-existing conditions and won't be covered. We recommend enrolling before you need services, as you cannot receive coverage for issues that arise before your membership activates.

Yes, but with important limitations. Through LegalShield's Tragic Accident Representation benefit, you receive coverage for manslaughter, involuntary manslaughter, vehicular homicide, and negligent homicide charges in the court of original jurisdiction. However, appeals are not covered, and charges must stem from a traffic accident. DUI/DWI, drug-related matters, hit-and-run, and leaving the scene of an accident are specifically excluded from coverage.
